- Waiver: The titles and headings to these
Gulliver's Travels Policies and Procedures
are for reference purposes only, and do not constitute, and shall not be
construed as substantive terms of these Policies and Procedures.
Gulliver's Travels
reserves the right to amend the terms and conditions of these Policies and Procedures at any time, as deemed
necessary without prior notice. Any notification of such amendments will
be communicated through any of Gulliver's Travels official channels of
communication, to include but not limited to, Independent Travel Agent
e-mail blasts and postings to the Gulliver's Travels Website and/or the
Gulliver's Travels Independent Travel Agent's Back Office.
Independent Travel Agent: A Gulliver's
Travels Independent Travel Agent, hereinafter referred to as an ITA, is
an independent contractor, responsible for his or her own business
activities and not an agent, employee or legal representative of
Gulliver's Travels, except insofar as the independent contractor status
will allow him or her to promote and engage in the marketing of
travel-related products and services.
- Requirements to Become a Gulliver's Independent
Travel Agent:
To become an ITA, each
applicant must meet all the following criteria:
- Be of legal age in his or her state of
residence.
- Reside in the United States, Bahamas, or a
U.S. Territory.
- Possess a valid Social Security Number or
Federal Tax ID number (Work Permits allow SSN but not business
ownership) as required by country of residence.
- Read and sign the Gulliver's Travels ITA
Agreement.
- Read and understand the Gulliver's Travels
Policies and Procedures. Submit a
Gulliver's Travels Policies and Procedures
Acknowledgement Receipt within 30 days of initial application. If
Gulliver's Travels does not receive either a signed acknowledgement
form via U.S. Mail/facsimile or a
digital signature acknowledgement through the activation
process/Gulliver's Travels Back Office, commission checks will be
withheld until the acknowledgment is received and the ITA's business
may be suspended.
The company reserves
the right to reject any application to become an ITA or to reject the
renewal of an existing ITA for any reason. If an ITA is initially
signed-up by someone other than themselves (sponsor, etc), that party
will assume responsibility for any incurred charge-back fees relating to
the new ITA.
- Non-Discrimination: Gulliver's Travels does
not discriminate in its acceptance or rejection of applicants because of
race, creed, sex, color, sexual orientation, marital status or national
origin.
- Independent Travel Agent Benefits: Once
Gulliver's Travels has approved an ITA application and the ITA has
activated their Gulliver's Travels Independent Travel Agent System, all
benefits of the Gulliver's Travels Independent Travel Agent System is
available to the new ITA. These benefits include the right to:
- Purchase Gulliver's Travels products and
services at the ITA price.
- Opportunity to upgrade to Premium Service.
- Receive commissions, if qualified.
- Receive periodic Gulliver's Travels
literature and other Gulliver's Travels communications.
- Participate in Gulliver's Travels sponsored
events including, but not limited to: support, training, motivation,
and recognition functions, upon payment of appropriate fees, if
applicable.
Gulliver's Travels offers
new ITAs access to negotiated benefits and privileges through Cruise
Lines International Association (CLIA). CLIA identification cards are
valid for a calendar year January through December. Identification cards
are not issued six weeks a year between September 1st and October 15th.
ITAs are required to complete an Agent Certification course and test
before renewal of card.
- Getting
Started: To participate in the Gulliver's Travels' Independent
Travel Agent Business as an ITA, the ITA must purchase the service
directly from Gulliver's Travels. Price may change without notice.
Annual maintenance fee required. Features are subject to change.
- Business
Start-Up: The Business Start-Up fee includes a Starter Pak
(padfolio, business cards and marketing materials) and a Gulliver's
Travels Independent Travel Agent identification number. The
identification number is required to log into the ITA's website and Back
Office, obtain quotes, place bookings and track commissions.
- Basic
Service: The Basic Service fee includes activation, basic access
to the Gulliver's Travels Call Center, and a customizable GDS booking
engine and website allowing the ITA and their customers to book trips
anywhere. Quote requests are only accepted by email or fax.
- Premium/Executive
Service: The Premium/Executive Service upgrade (monthly fee) receives all the benefits of Basic Service plus increased commission rates, annual renewal fee waiver, access to multiple upgrades, a toll-free number, quote requests by phone, access to Gulliver's Travels preferred vendors and benefits, when available. The monthly service charge will be automatically charged to the ITA's credit card recurring on the same day each month, which will be referred to as the billing date. An example: if Premium Service was activated on March 15, the billing date will be on the 15th of each month. Please be advised, Premium Service is non-refundable.
- Gulliver's Travels Identification Card: This ID card is used to identify Premium and Executive Service Independent Travel Agents affiliated with Gulliver's Travels and will grant access to Gulliver's Travels preferred vendors. A Premium/Executive Service ITA and eligible co-applicant is eligible to apply for a Gulliver's Travels identification card. To obtain the ID card, the ITA must submit a completed Application/Renewal of the Gulliver's Travels Identification Card form along with payment of a $15 non-refundable processing fee. A $15 processing fee will be charged to replace a lost or stolen ID card. This ID card does not guarantee or entitle any vendor/supplier discounts and/or benefits.
- Non-Profit Organizations: Non-Profit
Organizations agree to the above stated outline of Premium Service.
Non-Profit Organizations must provide Gulliver's Travels with proof of
Non-Profit status. Although the initial start-up fee is waived,
Non-Profits pay the monthly Premium Service fee. Non-Profit
Organizations are required to complete a Non-Profit Organization Application and
Agreement.
- Annual Maintenance Fee for the Gulliver's Independent Travel Agent Service: Participation in the Gulliver's Independent Travel Agent System is limited to one year. This term begins at the acceptance date of the ITA's application by Gulliver's Travels. ITAs must renew their service each year by paying an annual maintenance fee. Premium/Executive Service Members are exempted from this fee if Premium Service was purchased within the first 60 days of activation and this service is paid in full throughout the next nine months. Thereafter, to maintain this waiver, an ITA must maintain at least 10 consecutive months of paid up Premium Service. To ensure that an ITA does not forfeit his or her benefits by forgetting the annual contract date, and in order to make it more convenient, Gulliver's Travels will utilize an Automatic Renewal System (ARS).
- Operating the Gulliver's Independent Travel Agent
Business:
Gulliver's Travels works directly with the vendor
for the ITA and their customers. It is against company policy for an ITA
to contact a vendor directly.
ITAs must adhere to the terms as set forth in these
Policies and Procedures. ITAs shall not
offer the Gulliver's Travels business opportunity through, or in
combination with, any other travel system, or method of marketing other
than specifically stated in these Policies and
Procedures as Gulliver's Travels marketing alliances.
The ITA agrees to refrain
from engaging in contractual arrangements or agreements with vendors for
any and all related travel including personal and group bookings. The
ITA agrees to refrain from participating in any part of the booking
process, including quotes, (unless a qualified Executive Level member), related to any customers and or clients. All
related fees, additional costs and expenses resulting from a violation,
will be the responsibility of the ITA.
The ITA will not accept direct payment of any
monies from any customer and or client but will refer all transactions,
quotes, booking and processing of funds to be completed by the customer
and or client at the ITA website and/or the Gulliver's Call Center. ITA
is strictly prohibited from receiving money for any travel reservation,
or offering quotes other then what is displayed on the website. ITA
cannot substitute forms for booking purposes. Only Gulliver's Travels'
forms will be accepted and will be completed by only the customer and or
clients.
The ITA must
contact Gulliver's Travels to complete travel agent rate bookings. Premium/Executive members are authorized to contact; rental car agencies, hotels and qualifying Disney Resorts. ITA
will pay related processing fees. Travel agent rates are applicable when
ITA has met requirements and the rate is available.
In the event the ITA
contacts any vendor direct without following Gulliver's Travels Policies and Procedures it will result in ITA
paying fines, additional orphan fees, probation, suspension or
termination and commissions withheld pending Gulliver's Travels
compliance review.
- Trademarks and Copyrights: The name of
Gulliver's Travels and other names as adopted by Gulliver's Travels are
proprietary trade names, trademarks and service marks of Gulliver's
Travels. These marks are supplied to ITAs for use only in an expressly
authorized manner. Use of the Gulliver's Travels name on any item is
prohibited except printed as follows:
- [ITA's Personal or Business Name], an
Independent Travel Agent of Gulliver's Travels
- ITAs may list themselves as a 'Gulliver's
Independent Travel Agent' in the white or yellow pages of a telephone
directory under their name or their DBA name. No ITA will place
telephone directory display ads using Gulliver's Travels name or logo.
Said policy also applies to the internet yellow pages.
ITAs shall not answer the telephone: 'Gulliver's
Travels,' 'Gulliver's Travels Incorporated' or in any manner leading the
caller to believe he or she has reached the corporate offices of
Gulliver's Travels. ITAs shall not associate the Gulliver's Travels name
or any of its trademarks with their business or personal checking
accounts. ITAs may imprint business checks as being a 'Gulliver's
Independent Travel Agent'. ITAs are not permitted to create their own
business card or letterhead graphics if the Gulliver's Travels trade
name and/or trademarks are used. Only approved Gulliver's Travels
graphics versions and wording are permitted. Letterhead must be produced
using Gulliver's Travels business cards, as supplied by Gulliver's
Travels, to include the words 'Independent Travel Agent'. Gulliver's
Travels' marketing alliances may not be listed on any business cards or
stationery. These policies also apply to any signage produced by
ITAs.
If the ITA has
constructed their own website/webpages to promote their ITA business,
they must provide the Gulliver's Travels Compliance Department with the
url by filing an Advertising Approval Request
form. Accordingly, any changes or updates to the ITA's website will
require resubmission of the above-mentioned form.
- Media
and Media Inquiries: ITAs are prohibited from utilizing radio or
television media for the advertising, or promotion of Gulliver's Travels
services without the express written consent of Gulliver's Travels. In
the event Gulliver's Travels does grant permission for the use of such
media, Gulliver's Travels will have final authority on every stage of
the production process with full rights to all recordings. All requests
for approval must be submitted sixty days prior to advertising scheduled
dates to ensure adequate time for review.
ITAs may not produce for sale any recorded company
events or speeches without specific prior written consent from
Gulliver's Travels. ITAs shall not reproduce for sale, distribution or
for personal use any recording of company-produced audio or video taped
presentations.
ITAs are
prohibited from responding to media inquiries regarding Gulliver's
Travels, its products or services, or their independent Gulliver's
Travels business. All inquiries by any media must immediately be
referred to Gulliver's Travels' Compliance Department. Gulliver's
Travels employs a professional staff responsible for replying to these
inquiries. This policy assures accurate and consistent information to
the public.
- Advertising and Promotional Materials: To
promote the products, services and opportunities Gulliver's Travels
offers, an ITA must only use the sales aids and support materials
produced and or approved by Gulliver's Travels. Gulliver's Travels
carefully designs promotional materials and they remain in legal
compliance. This is done to ensure each aspect of Gulliver's Travels is
fair, standard throughout and complies with the vast and complex legal
requirements of Federal, State, Local and International laws.
For this reason, ITAs are
strictly prohibited from developing, distributing or selling their own
sales aids, promotional materials and other literature without the
written consent of the Gulliver's Travels Compliance Department. The
only exception is the personalized business cards which must still meet
criteria defined hereinafter.
ITAs may place advertisements or promotional
materials for the purpose of signing new travel customers. Said
materials are limited to advertisements or services, voice messages,
Fax-on-Demand, signage, printed correspondence, and electronic
distribution. Before any such material can be used, it must be submitted
for written approval on the appropriate form to the Gulliver's Travels
Compliance Department.
All marketing materials are in constant review by
Gulliver's Travels Legal and Compliance Departments, as well as Federal
and State regulatory agencies. Violation of any of Gulliver's Travels
guidelines will result in disciplinary action, including but not limited
to termination of the ITA's Gulliver's Travels business.
In the conduct of his or
her business, the ITA shall safeguard and promote the reputation of
Gulliver's Travels and its products and services. The marketing and
promotion of Gulliver's Travels, the Gulliver's Independent Travel Agent
System, Gulliver's Travels products and services shall be consistent
with the public interest, and will avoid all discourteous, deceptive,
misleading, unethical or immoral conduct or practices at all times.
- Changes
to the Gulliver's Travels Independent Agent Business: Each ITA
will immediately notify Gulliver's Travels of any changes to the
information contained within the ITA application. ITAs may modify their
existing ITA application, i.e., change Social Security Number to Federal
ID Number, by submitting appropriate supporting documentation.
- Cancellation, Termination, Re-Application and
Transfer: Basic Service cancellation is dependent upon Gulliver's
Travels receiving ALL travel credentials issued, i.e. CLIA and IATAN
card. Business cards must be destroyed. Website hosting is
non-refundable. No involvement with Gulliver's Travels products or
services is permitted without re-application to and acceptance by the
Company.
Premium
Service cancellation is dependent upon at least a 30-day notice prior to
the ITA's billing date by 1) contacting Gulliver's Travels Call Center,
and 2) submitting a signed Basic or Premium
Service Cancellation Form. This service and recurring charge will
only terminate on the date in which Gulliver's Travels receives the
signed cancellation form and all identification cards issued, i.e.
Gulliver's Travels identification card, CLIA and IATAN card. The ITA
will continue to be charged the monthly fee until the requested items
are received. Please be advised,
Premium Service and the Gulliver's Travels identification card are
non-refundable.
Involuntary Termination: Any ITA in violation of
these Policies and Procedures based upon
the seriousness of the violation, past conduct and the Compliance
Department's internal investigation, will result in probation,
suspension or termination. This decision shall be at the Company's sole
discretion. If Gulliver's Travels determines the violation warrants a
probation, the ITA will be placed on probation for a length of time
determined by the Compliance Department. If Gulliver's Travels
determines the violation warrants a suspension, the ITA will receive a
written notice from the Compliance Department and will not be able to
collect commissions or access their website Back Office. The ITA will
have the opportunity to contest said probation or suspension in
writing.
Gulliver's
Travels may immediately terminate service by written notice to the ITA.
Should any part of the Policies and
Procedures and/or the application be deemed to be invalid, the
balance of the Policies and Procedures
shall remain in effect. The ITA will receive a written notice and, if
terminated, forfeit any right to future commissions and all travel
credentials. Please be advised, Website hosting will remain active
through anniversary date, and is non-refundable.
An ITA business may be
inherited or bequeathed. It may be sold or transferred to a recipient
(or their immediate family) who is not currently, nor ever has been, a
Gulliver’s Travels ITA. ITAs interested in selling/transferring their
ITA business must complete a Request for the
Sale/Transfer of ITA Business form in its entirety. The originating
ITA will be billed a $100.00 administrative fee for the sale of their
ITA business. Please be advised, upon date of transfer, any and all
outstanding commissions roll over to the recipient of said ITA Business.
The recipient will assume sole responsibility of all financial
obligations of the ITA business, including fees. Gulliver’s Travels
reserves the right to approve the sale or transfer of an ITA
Business.
- Indemnification: An ITA is fully responsible
for all of his or her verbal and written statements made regarding
Gulliver's Travels and services, and for any which are not expressly
contained in current, official Gulliver's Travels materials. ITAs agree
to indemnify Gulliver's Travels and hold it harmless from any and all
liability including judgments, civil penalties, refunds, attorney fees,
court costs or lost business incurred by Gulliver's Travels as a result
of the ITA's unauthorized representations.
- Trade
Shows and Expositions: All Trade Show participation must be
registered and approved by Gulliver's Travels Compliance Department by
submitting a Request for Trade Show Attendance
Registration. Gulliver's Travels mandates only one ITA booth may
represent Gulliver's Travels at any Trade Show or Chamber of Commerce
Event. Gulliver's Travels reserves the right to approve or deny any
request. Requests are considered on a first come, first serve basis. The
first request approved by Gulliver's Travels Compliance Department will
be listed as Contact in ITA Back Office event schedule under Trade Show Schedule. Please submit all
requests to Gulliver's Travels Compliance Department 45 days prior to
show date.
In the event
an ITA finds a specific show already reserved, the ITA may contact the
person listed as the original Contact and propose sharing the booth or
expanding the booth to accommodate both parties in the exhibit hall. An
ITA may not compete with another ITA at any public event. Original
Contact has the right to decide whether another ITA may participate in
said Trade Show. Gulliver's Travels requires all participants agree to
terms related to finances, materials, and/or schedules prior to the
event. Please be advised, Gulliver's Travels will not be involved in
scheduling or assume financial responsibility for any event.
All Trade Show fees are
the responsibility of the ITA, who is Contact for said event. Fees
include, but are not limited to: booth space, electric outlets,
telephone service, Internet access, show publication advertisement, and
premium locations such as corners and main aisles.
ITA must use the term Independent Travel
Agent as listed on ITA business cards. ITA will not
contact any vendor at any event in attempt to cross prospect or
inquire/negotiate for business on behalf of Gulliver's Travels. In the
event any vendor or company requests information about Gulliver's
Travels, ITA will forward their contact information to Gulliver's
Travels Corporate Office and/or offer Gulliver's Travels contact
information.
All
registration information for any event must be listed under Contact
name, telephone number, and home/business address. ITA is prohibited to
use Gulliver's Travels contact information including mailing address or
telephone numbers for any billing or correspondence with Trade Show
organizers.
An ITA may
offer prospects access to website bookings at the event from ITA's
website. ITA is strictly prohibited from receiving money for any travel
reservation, or offering quotes other then what is displayed on the
website.
- Conflict
of Interest: For a period of one year after the cancellation
(cancellation may be either voluntary, involuntary, through non-renewal,
inactivity or termination) of an individual or entity's ITA service, the
ex-ITA shall not directly or through a third party solicit any
Gulliver's Travels ITA or customer for any other travel marketing system
or opportunity. This provision shall survive the termination or
cancellation of the ITA's service. If the solicitation of the ITA or
customer is performed by a third party outside the Gulliver's Travels
Independent Travel Agent System, Gulliver's Travels will undertake any
and all legal actions necessary to be compensated for the irreparable
harm caused by the unauthorized solicitation.
- Governmental Approval or Endorsement: No
Federal, State or Local regulatory agencies or officials 'approve' or
'endorse' a marketing company or system. ITAs shall not represent or
imply Gulliver's Travels has been 'approved,' 'endorsed' or otherwise
sanctioned by any government agency, except for published licenses where
applicable.
- Income
Taxes: Gulliver's Travels provides an IRS Form 1099 MISC.
(Non-employee Compensation) earnings statement to each ITA who had
earnings of over $600.00 in the previous calendar year.
- Independent Contractor Status: ITAs are
independent contractors and are not purchasers of a franchise. The
agreement between Gulliver's Travels and its ITAs does not create an
employer/employee relationship, agency, partnership or joint venture
between the Company and the ITA. ITAs shall not be treated as employees
for their services or for Federal, State or Local tax purposes. All ITAs
are responsible for paying any applicable taxes due from all
compensation earned as an ITA. An ITA has no authority, expressed or
implied, to bind the company to any obligation. Each ITA is encouraged
to establish his or her own goals, hours and methods of sale, providing
he or she complies with the terms of the Policies and Procedures and any applicable
laws.
- International Marketing: Because of critical
legal and tax considerations, including, but not limited to, compliance
with foreign laws regarding approval, registration, regulations
regarding statements, taxes, literature content and language
requirements, ITAs are authorized to sell Gulliver's Travels services
only in the countries in which Gulliver's Travels is authorized to
conduct business, as announced in official company literature.
- Compliance with Federal, State, Local and
International Laws: ITAs shall comply with all Federal, State,
Local and International laws in the conduct of their business. The
violation or attempted violation of any such law or regulation, or
fraudulent or deceptive conduct, shall be grounds for disciplinary
action by Gulliver's Travels.
- Minors: A Minor is a person who is not of
legal age, as recognized by the state or province in which they reside
to enter a legal and binding contract. Minors are, therefore, ineligible
to participate as an ITA, regardless of an adult with legal guardianship
granting permission. No one under eighteen (18) years of age, in any
jurisdiction, shall be permitted to become an ITA.
- Release
for use of Photographic, Audio, Video Image, and/or Testimonial
Endorsement: All ITAs hereby grant to Gulliver's Travels and its
successors, assigns, employees and agents, the absolute and irrevocable
right and permission, with respect to any photograph, audio and/or video
picture taken of them, or in which they may be included with others, and
with respect to any testimonial endorsement:
(a)
To use, reuse, broadcast, rebroadcast, publish, or republish such
photograph, audio, video, or endorsement, in all or in part,
individually or in conjunction with any other photograph or video, or
any other endorsement, in any current or future medium and for any
purpose whatsoever, including but not limited to: marketing,
advertising, promotion, and/or publicity. (b) In the case of visual
representations, to copyright such photograph and/or video, in the
original or as republished, in the name of Gulliver's Travels, Inc., or
in any other name. ITAs hereby confirm the information given by them as
a testimonial endorsement, or represented in a photograph, video or
audio is true and accurate to the best of their knowledge. By submitting
the testimonial, the ITA hereby waives any right they may have to
inspect or approve the finished or unfinished product or products, the
advertising copy, printed, recorded, photographic or video matter which
may be used in connection therewith, or the use to which it may be
applied. (c) ITAs hereby release and discharge
Gulliver's Travels and their successors, assigns, employees, and agents,
from any and all liability, claim and/or demand arising out of or in
connection with the creation and the use of the above-mentioned
photograph, video, audio or endorsement, including any claim for
defamation. This includes, but is not limited to, telephonic recordings
at Corporate Offices made for training or quality control purposes.
- Booking
Payments: Forms of payment for airline tickets, cruise
reservations, tour reservations, hotel reservations and rental cars are
as follows:
- Wire Transfer
- Certified Bank Check
- Money Order Check made payable to Gulliver's
Travels
- American Express Credit Card
- Discover Credit Card
- MasterCard Credit Card
- Visa Credit Card
Please be advised, personal checks require ten days
to clear the bank. Gulliver's Travels must be in possession of full
cleared payment for any documents or tickets issued; therefore, there
can be NO fare guarantees during this hold for payment period. Some
suppliers may restrict credit cards accepted and may refuse credit card
payment on special rates. Gulliver's Travels charges fees to process
airline tickets, as the airline industry does not offer commissions.
However, if ITA has Premium Service, Gulliver's Travels does pay $2.50
for all non-commissionable airline tickets.
- Commission Structure: Gulliver's Travels
shall pay commissions to said ITA in accordance with the Gulliver's
Travels Independent Travel Agent System. Assuming payment by the vendor
is made to Gulliver's Travels in a timely manner, Gulliver's Travels
receives commissions from various travel suppliers and vendors
approximately 30 to 90 days after a trip is completed. Gulliver's
Travels issues the ITA commissions after the 25th of the following
month. Vendor commissions are calculated on the base fare of the cruise,
air, train, etc. and are not paid on taxes, Airport Fees, Cruise Port
Charges, or any other fees not related to the actual fare for
passage.
ITAs receive
25% of the commission Gulliver's Travels received from the vendor on
Call Center bookings and 40% of commission Gulliver's Travels received
from the vendor on website bookings (if travel is available to be booked
on the website). Premium and Executive Members receive 50%, 65% respectively of paid commissions whether booked on the web site or through the call center.
If an
ITA resigns or their business is terminated, any travel booked, but not
yet paid for or taken by date of resignation and/or termination,
commissions resulting from said travel booking are forfeited.
Average Industry Commissions: Domestic Airlines: none Select International Airlines: 3-8% Cars and Hotels: 5% - 10% Tours and Groups: 10% - 15% Cruises: 12% - 15% Gulliver's Preferred Vendors: 17% - 20%
Commissions cannot be
requested or received by the ITA directly from the vendor. An ITA
requesting or receiving commissions will be automatically terminated.
ITA will be fined and commissions will be withheld.
- Monthly
Auto-Ship System: Under this System, the ITA authorizes
Gulliver's Travels to have a specified dollar amount drafted
automatically from their checking account or credit card account. This
amount is based upon monthly fee for Premium Service and includes annual
maintenance fees.
- Returned
Checks: All checks returned by an ITA's bank for insufficient
funds will not be re-submitted for payment. A $45.00 returned check fee
will be charged.
- Charge-Backs: ITAs agree they will not
resolve billing disputes through the issuance of charge backs to their
credit cards. All billing disputes must be handled by contacting the ITA
Services Department or ITA Services Manager at Gulliver's Travels. If
unable to achieve resolution through these channels, the ITA should
contact the Compliance Department. Charge-backs are costly to the
company including loss of revenue and product and fees charged by the
credit card companies. Failure to follow these procedures will result in
termination of the ITA's business.
An ITA who files a charge-back without first
allowing Gulliver's Travels to resolve the dispute internally, will have
their ITA business terminated. Filing a false charge-back claim rather
then using the normal refund procedure may result in civil charges being
filed by Gulliver's Travels against the offending party.
- Investigations: Investigations are conducted
by the Gulliver's Travels Compliance Department to protect the ITAs,
consumers and the company against negative publicity, legal
ramifications or financial hardship and to ensure the adherence to the
corporate guidelines outlined in these Policies
and Procedures. Investigations are a non-biased collection and
examination of facts and circumstances surrounding a particular action,
event, or individual where there is reason to believe a violation of the
Gulliver's Travels Policies and Procedures
has occurred.
In order
to resolve any issues in a timely manner, ITAs agree to cooperate fully
and provide complete and accurate information to the investigator.
Failure to cooperate fully and in a timely manner, whether the subject
of the investigation or an ancillary witness, may result in sanctions
against the ITA's business.
- Seller
of Travel Laws: California, Hawaii, Florida, Iowa, Nevada, Rhode
Island, and Washington State require all travel agencies to register as
a Seller of Travel and to comply with bonding and/or trust account
requirements for sales to clients located in those states where
Gulliver's Travels services are promoted. ITAs are required to place
Gulliver's Travels Seller of Travel Registration Number on all marketing
materials and or business cards used to promote Gulliver's Travels
services. ITAs will not accept direct payment of any monies from any
client but will refer all transactions, booking and processing of funds
to be completed at the Gulliver's Travels website and/or Gulliver's
Travels Call Center. Accordingly, ITAs shall either comply with the
foregoing requirements or shall register as a Seller of Travel under the
applicable state law or laws. Although there are thousands of governing
laws and statutes on the books in the numerous jurisdictions in which
ITAs operate, there is one critical new state law which requires
specific publication in these Policies and
Procedures, to wit: ITAs residing in Florida will be required to
complete a Sellers of Travel Independent Sales
Agents - Statement of Exemption annually.
- Travel
Services Terms and Conditions (reservations, bookings,
purchases): The ITA agrees to abide by the terms and conditions
of purchase imposed by any vendor/supplier the ITA elects to deal with.
All terms and conditions will apply, including cancellation and deposit
policies, when purchasing products and services from vendors and or
suppliers. Gulliver's Travels assumes no responsibility or liability for
any errors or omissions from vendors and or suppliers. Gulliver's
Travels requests travelers to review and evaluate all travel
prohibitions, warnings and advisories issued by the government before
booking travel to international destinations. By offering sales to
international destinations, Gulliver's Travels does not represent or
warrant said travel is advisable or without risk, nor does Gulliver's
Travels assume liability.
- Governing Law, Jurisdiction and Venue:
Jurisdiction and venue of any matter not subject to arbitration shall
reside in Sarasota County, Florida, U.S.A. The law of the State of
Florida shall govern all disputes arising from the Agreement.
By affixing my signature
below, I acknowledge I am in receipt of the Gulliver's Travels Policies
and Procedures, dated January 1, 2008. I have read this document in its
entirety and understand the contents.
I further understand the information, policies,
fees and benefits herein are subject to change and acknowledge revisions
to said Policies and Procedures may occur. I understand all such changes
will be communicated through Gulliver's Travels website and email
blasts. I also understand all revised information will supersede, modify
or eliminate existing policies.
I also understand, as an ITA, certain travel
industry vendors offer certain courtesies, discounts and or other
incentives determined by the industry vendors and not Gulliver's
Travels.
I understand
any courtesy available is based on vendors' policy and may require
certification or qualifications. I understand purchasing the Gulliver's
Independent Travel Agent System does not guarantee benefits, discounts
or any other incentive.
I understand in the event I cause harm to
Gulliver's Travels reputation and or relationship as a result of
demanding benefits or being unprofessional, resulting in complaint(s)
from any vendor, may result in my ITA status terminated and/or
commissions withheld. I will make no false or misleading statements
about Gulliver's Travels, its products and or services.
